By using our hosting services, you agree to the following terms and conditions. Please read them carefully as they govern your access to and use of our services.

Acceptance of Terms

By signing up for and/or using EclipseNode’s hosting services (the “Services”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Services.

EclipseNode reserves the right to modify these Terms at any time, and it is your responsibility to review them periodically for changes. Continued use of the Services after any changes to the Terms constitutes acceptance of those changes.

Eligibility

To use EclipseNode’s Services, you must:

• Be at least 13 years old, except where a higher minimum age is required by local law.
• For products over £50 / Dedicated Servers, you must be over 16 years of age and be prepared to show Identification documents.
• Keep your billing information up to date to comply with KYC (Know Your Customer) and the UK Data Protection Act 2018.
• Not be barred from receiving services under applicable laws.

Description of Services

EclipseNode provides hosting services, including but not limited to:

• Game Server Hosting
• Virtual Private Servers (VPS)
• Discord Bot Hosting

The services and their associated resources, including bandwidth and storage, are subject to the limitations and usage policies described in your specific hosting plan.

Account Responsibilities

You are responsible for:

• Keeping your account details secure.
• Maintaining accurate and up-to-date contact information.
• All activity under your account, whether authorized by you or not.

If you believe your account has been compromised, you must notify us immediately.

Acceptable Use Policy (AUP)

Please refer to the Usage Policy.

Payment Terms

• All services are provided on a prepaid basis unless otherwise specified.
• Payments must be made in full before the start of each billing cycle.
• Late or missed payments may result in suspension or termination of services.

You agree to provide EclipseNode with accurate payment information and authorize us to charge all applicable fees to your payment method.

Service Availability & Uptime

EclipseNode strives to offer high uptime and reliable services. Please refer to our SLA for more information about what we do and do not cover.

Backups & Data Security

EclipseNode performs routine backups of your data. However:

• You are responsible for maintaining your own backups of your data.
• EclipseNode is not liable for any loss of data, corruption, or security breaches unless caused by gross negligence on our part.

Intellectual Property

You retain all rights to your content hosted on EclipseNode’s servers. However, by using our Services, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display your content for the purposes of providing the Services.

You must ensure that you have all necessary rights and permissions for any content you host on our servers.

Termination of Services

Either party may terminate these Terms at any time by providing notice to the other party. EclipseNode reserves the right to:

• Terminate or suspend your account for any violation of these Terms or AUP.
• Issue refunds at our discretion based on the circumstances of termination.

Upon termination, your access to the Services will be revoked, and your data may be permanently deleted.

Limitation of Liability

To the fullest extent permitted by law, EclipseNode shall not be liable for:

• Any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business.
• Any damages exceeding the amount you paid to EclipseNode in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold EclipseNode, its employees, affiliates, and agents harmless from any claims, damages, or expenses arising from your use of the Services, including any violation of these Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

By using EclipseNode’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
